Based on years of protecting families as a prosecutor, the State has contracted with Mr. Cohen to represent children in civil neglect and criminal matters filed by local prosecutors and their human services counterparts. Mr. Cohen is available to be privately retained to fight for your children in these matters. ​

Mr. Cohen is appointed by the State to represent the best interest of children as a Guardian Ad Litem (GAL) in cases in which children are charged with crimes just like adults, but face very different and daunting outcomes under the Colorado Children's Code.  Convictions for some of these crimes, such as sex offenses, can result in sentences to prisons known as youth corrections, lifelong stigmas and inability to live at home. ​

A child wrapped up in the court system needs an experienced attorney on board early, who can calmly and steadily guide the child through the laws and protect his or her rights.The best approach in  juvenile criminal cases is to obtain counsel in the investigative stages, before a child is arrested or before the county DHS removes children  based on allegations against parents. If a case already has been filed, then it is equally important, if not more so, to obtain legal representation immediately.
 


The U.S. Supreme Court considers a parent's right to rear his or her child as a liberty interest protected by the U.S. Constitution. Yet every day, county human services agencies, based on what are often anonymous allegations and cursory investigations, remove children from their parents. Mr. Cohen can help you reunite your family and protect your constitutional rights.

These D&N cases all are initiated under the Colorado Children's Code, a series of laws enacted mainly to protect childrens' safety, and best interests in civil dependency and neglect cases and rehabilitate rather than punish children in criminal cases. However, the laws within the code -- and related domestic relations and criminal laws in Title 14 and Title 18 of the Colorado statutes -- can be complex and confusing.

The results also can have a lifelong impact on a child's and family's future and freedom, such as allocation of parental rights to a non-parent, or total termination of parental rights and resulting kinship placement or stranger adoption.  Mr. Cohen knows how to guide children and parents through such cases, negotiating with and challenging local prosecutors and human services agencies to achieve the best outcome.

We will then formulate a proposal where the marital assets and debts (including real estate, investments, personal property, bank accounts, life insurance, credit cards, automobiles, etc.) are divided fairly.

​ In sex assault on a child cases, the difference between the prosecution charging one act or two can mean the difference between probation eligibility or a potential lifetime prison sentence.

Child Support
In your divorce, legal separation, paternity, or allocation of parental responsibilities matter we will assist you with obtaining a child support order or modifying a current child support order, pursuant to Colorado law. 

Child support in Colorado is governed by C.R.S. Sec. 14-10-115.  Important factors include each party's income, the amount of overnights each party has with the children, the children's health insurance premium cost, and childcare costs as well as any extraordinary educational or medical costs for the children.  We will discuss your rights and obligations to support your child or children under Colorado law in an easy to understand matter so that you can decide the best course of action to take.  We will also guide you through the income disclosure process required when establishing or modifying child support.

Spousal Maintenance (Alimony)
Maintenance is governed by C.R.S. Sec. 14-10-119.  Recent law established a guideline for what you can expect to pay or receive based upon each parties' income and the length of the marriage.  We will provide you with these guidelines and help you decide the best course of action.

If a trial is warranted and necessary because the DAs offer is not acceptable, the lawyers at Peak Legal Services, LLC, are ready to fight for you. Mr. Cohen's last trial as a Deputy DA involved a complex felony child abuse and habitual criminal case. His last 1st-degree murder case just resolved in 2016 with the Defendant receiving a reduced charge and a much shorter sentence.
